Practical Daily Criminal Law

Introduction

This aims to equip participants with first-hand knowledge and information in daily situations that legal implications may arise and avoiding pitfalls that may flow from the criminal nature of one's daily activities. Those who attend this course will be able to acquire a greater understanding of the structure of the criminal justice system in Hong Kong. This course focuses on examining the most popular criminal offences in Hong Kong in a litigation perspective. Hence, after completing this course, participants are capable of handling a simple criminal case in a layman's aspect.

Objective

To understand the principles of the criminal law in various aspects and apply them to protect one's own rights conferred under the law with ease in real life situations.

Course Outline

  1. Crime and Criminal Law – nature of criminal law, purpose of the criminal justice system, criminal law and the European Convention on Human Rights & the Human Rights Ordinance
  2. Judiciary System and Criminal Court Procedures
  3. Principles of Criminal Liability - actus reus, mens rea, causation, recklessness, negligence, strict liability
  4. Property Offences - theft, robbery, burglary, obtaining property by deception, blackmail,? handling stolen goods, going equipped for burglary or theft, criminal damage
  5. Non-fatal Offences Against the Person, including Sexual Offences - assault and battery, wounding, assault occasioning actual bodily harm, administering poison or other noxious thing, indent assault
  6. Dangerous Drugs Offence - possession of a dangerous drug, trafficking of a dangerous drug, possession of Part I poison
  7. Offences Against Public Officers - assault on a public officer, obstruction of a public officer, misleading a public officer, resisting a public officer
  8. Offences Against Public Order and Other Offences - fighting in public place, taking part in unlawful assembly, possession of offensive weapon in a public place, claiming to be a member of a triad society, criminal intimidation, making-off without payment, fraud, behaving in a disorderly manner in a public place, forgery, using a false instrument
